This Policy describes how we treat information we collect online and other offline sources. This Privacy Policy applies to current and former visitors to our application and to our online Clients & users. By visiting and/or using our application, you agree to this Privacy Policy.

Based on whether you are a Visitor, Client or User, the type of data we collect and the purpose for which we use it will differ as mentioned hereinafter-

IP address other necessary details of you or your representative.

We collect information you post in a public space on our application or on our or any third-party social media platform.

We might collect this as a part of a survey also.

Information you provide through our Services, including your reviews, photographs, comments, lists, followers, the users you follow, food choices,current and prior restaurant reservation details, food ordering details and history, tastes and preferences (such as your favorite food, purchases or recipes, meals, favorite restaurants, special restaurant requests, contact information of people you add to, or notify of, names, and other information you provide on our Services, and other information in your account profile.

E. Other information

• a. How you behave in the relevant product environment and use the features;
• b. How you behave on the Application, (how you land on, how much time you spend, what you access and features used etc.);
• c. We might also collect the type of mobile device you are using, location or model, the version of the operating system your computer or device is running.
• d. If you submit an inquiry through the Application, we will ask for your: Name; ande-mail.
• e. Data from third parties who have your explicit consent to lawfully share that
  data;
• f. When you use the FreshPlate application, we track and monitor some of your activities on and off the FreshPlate Application and store and access some data about you; your browsing history and your usage of the Application.

2. HOW AND WHY, WE USE IT

Our primary purpose in collecting personal information is to provide you with a secure, smooth, efficient, and customized experience.

A. To contact you

We might use the information you provide to contact you for confirmation of a purchase on our application or for promotional purposes or for better services.

B. To register your account or respond to your questions

We might use your information to confirm your registration for a service. We might also use the information to work on your concerns and to respond to your questions. In the event you report an issue with a service, we may also screen/video record your Device (only when you use the App) for a limited time period to help us better understand the issue.

C. To improve our products and services

We might use your information to analyze and identify your behavior and enhance the interactions you have with the Application. This could include displaying content based upon your preferences, most used features, your Wishlist, custom offers. It helps to provide and administer the Products and Services.

D. We use information for security purposes

We may use information to ensure network and information security, protect your account from any possibility of hacking or illegal access or breach of data,preventing unauthorized access to our computer and electronic communications systems;

E. We use information for marketing purposes

We might send you information about special promotions or offers. We might also tell you about new features or products. If you submit your details and give us your consent, we may use your data to send you emails/newsletters, or re-market our Services/Products using services from third-parties like Facebook ,Google & authentic lead generation tools. • a. Who perform services on our behalf We share information with vendors who help us manage our online registration process or payment processors or transactional message providers, support providers, server providers, network operators, etc. Our partners use this information as per their privacy policy.
• b. In order to comply with the law or to protect ourselves We will share information to respond to a court order. We may also share it if a government agency or investigatory body requests. Or, we might also share information when we are investigating potential fraud.

• d. Any successor to all or part of our business For example, if part of our business is sold, we may give our client list as part of that transaction. We may share your information for reasons not described in this policy. We will tell you before we do this.
• e. FreshPlate may accompany third parties in the use of technologies to collect information from your device to a server. They might collect online content, videos, and emails, and can allow a server to read certain types of information from your device, know when you have viewed particular content or particular email, message, and also determine the time and date on which you viewed information and the IP address of your device. This technology is used for various purposes along with analyzing the use of our Services and offering content and advertisements which are relevant to the user's lifestyle.

3. How we collect information in different ways

A. We collect information directly from you

When you register/subscribe for an account, fill a form, post a comment or contact us through app, phone or email.

B. We collect information from you passively

We use tracking tools like Google, Facebook, Clevertap for collecting information about your usage of our application.

C. We get information about you from third parties

For example, if you use an integrated social media feature on our applications. The third-party social media platform will give us certain information about you.This could include your name and email address.

D. As we adopt additional technologies, we may also gather additional data through other methods.

4. RETENTION OF PERSONAL INFORMATION

• A. We will store any personal data we collect from you as long as it is necessary in order to facilitate your use of the Products and Services and for ancillary legitimate and essential business purposes – these include, without limitation, for improving our Products, Services, attending to technical issues, advancement and dealing with disputes.

5. TRACKING BY OUR ADVERTISEMENT PARTNERS

Upon receiving your specific consent, we may use third-party advertising companies to serve ads when you visit our Application. These companies may use information(including your name, address, email address, telephone number) about your visits to this and other Applications in order to provide you with targeted advertisements and requirements about our Products and Services of interest to you.

6. PERSONS UNDER THE AGE OF 18

FreshPlate does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register for the Products and Service. The Products, Services and its content are not directed at children under the age of 18. In the event that we learn that we have collected personal information from a child under age 18, we will delete that information as quickly as possible.

7. THIRD PARTY LINKS

We may display links to third-party Applications or on website or our application for advertising or providing you with relevant content. We will not be responsible for such third-party Applications if you choose to access them. If you click on one of the links to third party Applications, you may be taken to applications or websites we do not control. This policy does not apply to the privacy practices of those applications or websites. Read the privacy policy of other applications or websites carefully. We are not responsible for these third-party platforms.

8. Email Opt-Out

We provide all users with the opportunity to opt-out of receiving non-essential(promotional, marketing-related) communications from us or on behalf of our partners.

If you want to remove your contact information from our server or want to unsubscribe to any newsletters or alerts from us or you want to opt out of receiving our marketing emails, to stop receiving our promotional emails, please email
……@……….. It may take about 10 days to process your request. Even if you opt out of getting marketing messages, we will still be sending you transactional messages through email and SMS about your purchases.

9. Security Precautions

Our Application has stringent security measures in place to protect the loss, misuse, and alteration of the information under our control. Once your information is in our possession, we adhere to strict security guidelines, protecting it against unauthorized access.

10. Governing law

If you choose to visit the Application, your visit and any dispute over privacy is subject to this Policy and the Application's terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India. Jurisdiction shall be at the court of Bengaluru High Court

11. Acknowledgement

• A. By using the Application and the Services provided therein, you agree and consent to the collection, transfer, use, storage, disclosure and sharing of your information as described and collected by us in accordance with this Policy including but not limited to Your consent for sharing your information as per this Privacy Policy.
• B. Your continued use of our application will be regarded as acceptance of our practices around privacy and personal information.
• C. If you have any questions about how we handle user data and personal information, feel free to contact us. If you do not agree with the Policy, please do not use or access the Application.
• D. You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.

13. SECURITY OF YOUR PERSONAL INFORMATION

We implement industry-standard technical and organizational measures by using a variety of security technologies and procedures to preserve the integrity and security of all information & protect your data from unauthorized access, use, loss, destruction or disclosure. Your password is your first line of defense once you set up a FreshPlate account, so we recommend that you set a strong password which you never share with anyone and ensure you sign out of your FreshPlate. However, no security system is impenetrable and we cannot guarantee the security of our systems account once you have used that same.

14. Updates to this policy

We may occasionally make changes to the Policy. If we do any material changes, we shall notify either by sending you an email or sending you a notification through the FreshPlate App as required by Law. We will also post an updated copy on our application. Please check our application periodically for updates.
